FONTAINE Membership Terms and Conditions
Article 1 (General Provisions)
1. The membership organization "CLUB VILLA FONTAINE" (hereinafter referred to as "this organization") defined in these Terms and Conditions is operated by Sumitomo Fudosan Villa Fontaine Co., Ltd. (hereinafter referred to as "our company").
2. These Terms and Conditions govern all relationships between CLUB VILLA FONTAINE members (hereinafter referred to as "Members") who join our organization and our company.
3. In addition to these Terms and Conditions, all rules, regulations and rules established by our company when using this organization (including individual notices given by our company to members) shall constitute part of these Terms and Conditions (hereinafter collectively referred to as the "Terms and Conditions").
Article 2 (Members)
A "member" is an individual who has accepted these terms and conditions, applied for membership in accordance with the procedures set out in Article 3 and other procedures prescribed by the Company, and whose membership has been approved by the Company.
Article 3 (Membership)
1. If you wish to join, please apply by entering the required information on our designated website or app.
2. Even after the registration of the membership application is completed, the application may not be approved after the Company's review. The content of the review and the reasons for the decision will not be disclosed to the Member. Furthermore, the Member may not raise any objections to the results of the review.
3. Membership cards will not be issued.
4. Membership registration is limited to one time (one registration) per person.
Article 4 (Membership Fees and Annual Fees)
There is no membership fee or annual fee.
Article 5 (Membership Qualifications)
Anyone who falls under any of the following items cannot become a member. Furthermore, if it is discovered that any of the following applies to you after you have joined, we may cancel your membership and member benefits. In such cases, we will not notify you.
① When a false statement is made at the time of joining.
② If you are a minor (unless you have parental consent).
③ When your address, telephone number, or other contact details become unknown.
④ When you fail to pay the accommodation fees or other charges pursuant to our accommodation agreement, or when your payment is delayed.
⑤ When the guest does not comply with our accommodation terms and conditions and usage rules.
⑥ When the Member damages the reputation of the Company or disrupts order.
⑦ When there is any act that violates these Membership Terms and Conditions.
8. When the person is a member of an organized crime group, a member of an organized crime group or related parties, or other anti-social forces.
9) When the organization's business activities are controlled by a criminal organization or a criminal organization member.
10. Any other case in which the Company determines that the Member is inappropriate to be a Member.
Article 6 (Benefits)
1. Members may receive benefits stipulated by the Company in the following cases:
① When you inform us at our front desk or other location that you are a member.
② When you complete the specified procedures on our designated website or app.
2. Details of the benefits will be posted at the front desk of our hotels or on our designated website, app, etc.
3. The Company may change the contents of the benefits at any time without prior notice to or consent from the Member.
Article 7 (Loss of membership and withdrawal)
1. A member will lose his/her membership for the following reasons:
① Withdrawal
② Death
③ When any of the items in Article 5 apply
2. Members may cancel their membership at any time by following the procedures specified by our company.
3. Membership is personal, and upon the death of a member, the member will automatically terminate his/her membership. Upon termination of membership, all benefits and remaining points will be lost.
Article 8 (Transfer of Membership)
Membership qualifications, benefits, and points may not be used by a third party, loaned, transferred, or offered as security.
Article 9 (Changes to registered information)
If you wish to change any registered information such as your address, name, or email address, please notify us as soon as possible. Please note that we will not be held responsible for any delays or failures in the delivery of notices or other materials sent by us due to a member's failure to notify us.
Article 10 (Member Information)
Members understand and agree to the following personal information protection policy established by our company.

Article 11 (Changes to Terms)
The Company may revise or change these Terms and Conditions at any time by changing or deleting clauses or adding new provisions without prior notice to or consent from the Member.
Article 12 (Termination of Membership Organization)
This organization may be terminated with prior notice.
Article 13 (Disclaimer)
Our company may suspend or interrupt the provision of all or part of the services under these Terms and Conditions due to system failures caused by natural disasters such as fires, power outages, earthquakes, or other reasons, or system maintenance or other operational failures. In such cases, our company shall not be liable for any disadvantages or damages suffered by members or third parties, regardless of the reason, except in cases where our company is guilty of willful or gross negligence.
Article 14 (Language used)
These Terms and Conditions have been written in Japanese, and even if they are translated into other languages, the Japanese version shall take precedence and be effective.
Article 15 (Governing Law)
The governing laws of these Terms and Conditions shall be governed by the laws of Japan.
Article 16 (agreed jurisdiction)
Any disputes arising between a member and our company shall be submitted to the Tokyo District Court as the court of first instance with exclusive jurisdiction.
Supplementary Provisions
These Terms and Conditions shall come into effect on April 21, 2020.
